Filing joint petition

Both parties jointly file a single petition seeking divorce stating the reason for their reason which should be genuine and reasonable.

1st motion – statement of both parties recorded before the court for it to verify their intent, reason and consent to get separated and also the parties’ understanding of the terms of separation.

Cooling off period

As marriage is an important decision of one’s life , so is divorce. Our legal system endeavours to keep the marital bond intact and hence gives both the parties to rethink and introspect for one last time on their decision to get separated. Hence a period of 6 months cooling off period is provided by the law before the parties move to the second and final motion. This period may be waived
at the discretion ofvthe court in case of special circumstances.

2nd motion – The court reconfirms the decision of both the parties to seperate.
Once reconfirmed, decree of divorce is issued.
